Terms of Service

These Terms of Service ("Terms") constitute a binding legal agreement between Mufungo Geeks ("Mufungo POS," "we," "us," or "our") and you, the store owner, merchant, or authorized business representative ("Merchant," "you," or "your") who registers for or uses Mufungo POS — including the mobile application (iOS & Android) and the web application at mufungogeeks.com/apps/pos (collectively, the "Service").

By creating an account, installing, accessing, or using Mufungo POS on any platform, you agree to these Terms. If you do not agree, do not use the Service.

Mufungo POS provides cloud-connected and offline-capable point-of-sale tools including product management, sales processing, receipt printing, reporting, staff access controls, and data synchronization.

Features may vary by platform, subscription tier, or app version.

• You are solely responsible for the accuracy of products, prices, tax settings, and transaction records entered into Mufungo POS.
• You are responsible for maintaining the confidentiality of your store owner credentials, manager passwords, and all cashier PINs. Do not share PINs with unauthorized persons.
• You must promptly deactivate staff PINs for employees who leave your business.
• You are responsible for compliance with all applicable tax, consumer protection, receipt, and retail laws in your jurisdiction.
• You must obtain valid customer consent before collecting contact information for e-receipts or marketing purposes.
• On the web app, you are responsible for securing your browser session and clearing local data on shared or public devices.

Mufungo POS supports offline operations on both mobile and web so you can continue selling when internet connectivity is unavailable. However:

• The Merchant is responsible for connecting to the internet periodically to ensure cloud synchronization, backup, and multi-device consistency.
• Data processed exclusively on a local device or in browser storage while offline may be lost if the device is damaged, reset, browser data is cleared, or the session ends before syncing.
• We are not liable for data loss resulting from failure to sync, prolonged offline use, or device or browser failure prior to successful cloud backup.

You agree not to use Mufungo POS to:

• Process fraudulent, illegal, or unauthorized commercial transactions
• Engage in money laundering, tax evasion, or any unlawful business activity
• Circumvent security controls, App Check, or staff access restrictions
• Reverse engineer, scrape, clone, or resell the Service without authorization
• Upload malicious code or attempt to disrupt our infrastructure
• Misrepresent your business identity or impersonate another merchant

We reserve the right to suspend or terminate accounts that violate these rules or pose a security or legal risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUFUNGO POS AND MUFUNGO GEEKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OR GOODWILL.

Without limiting the foregoing, Mufungo POS is expressly not liable for:

• Business revenue losses or missed sales during local device failure, power cuts, internet outages, or hardware malfunctions
• Thermal printer disconnects (mobile), browser print failures (web), paper jams, Bluetooth pairing failures, USB connection issues, or third-party printer hardware defects
• Accounting errors, tax miscalculations, inventory discrepancies, or financial reporting mistakes caused by incorrect manual inputs, misconfigured tax rates, or improper staff use
• Loss of unsynchronized local data before cloud backup completes
• Actions or omissions of your staff, contractors, or customers

Mufungo POS is provided as a software tool. You remain fully responsible for your business operations, financial records, and compliance obligations. Our total liability for any claim arising from the Service shall not exceed the amount you paid us for Mufungo POS in the twelve (12) months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH ALL DEVICES, BROWSERS, OR PRINTERS.

You may stop using Mufungo POS at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees (if any), or if continued service would violate law or create security risk. Upon termination, your right to use the Service ceases immediately. Data deletion is governed by our Account & Data Deletion Policy.

Mufungo POS, including its software, design, trademarks, and documentation, is owned by Mufungo Geeks and protected by intellectual property laws. Your use of the Service is governed by these Terms and our End User License Agreement (EULA).

Our collection and use of personal and business data is described in the Mufungo POS Privacy Policy, which is incorporated into these Terms by reference.

We may modify these Terms at any time. Updated Terms will be posted at this URL with a revised "Last updated" date. Material changes may also be communicated through the App or by email. Continued use after changes take effect constitutes acceptance.

These Terms shall be governed by applicable laws in the jurisdiction where Mufungo Geeks operates, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
