End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between Mufungo Geeks ("Licensor") and you ("Licensee") for the Mufungo POS software — including the mobile application (iOS & Android) and the web application at mufungogeeks.com/apps/pos — together with any updates, documentation, and related materials (collectively, the "Software").

By downloading, installing, accessing, or using the Software on any platform, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.

Subject to your compliance with this EULA and our Terms of Service, Mufungo Geeks grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Mufungo POS Software solely for your internal business operations as an authorized merchant or staff member of a registered store.

This license does not sell or transfer ownership of the Software to you.

You may not, and may not permit any third party to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application binary, native modules, or backend API logic, except where such restriction is prohibited by applicable law
• Clone, copy, modify, or create derivative works of the Software or any portion of it
• Scrape, probe, or replicate Mufungo POS backend API endpoints, authentication flows, or cloud database structures for competitive or unauthorized purposes
• Rent, lease, lend, sell, redistribute, or sublicense the Software to third parties
• Remove, alter, or obscure proprietary notices, trademarks, or copyright labels
• Use the Software to build a competing product or service
• Bypass Firebase App Check, Play Integrity, staff PIN controls, or other security mechanisms

The Software, including all copyrights, trademarks, trade secrets, patents, and other intellectual property rights, is and remains the exclusive property of Mufungo Geeks and its licensors. No rights are granted except as expressly stated in this EULA.

We may provide updates, patches, or new versions of the Software at our discretion. Such updates may be required for continued access to cloud services. Updates are subject to this EULA unless accompanied by separate terms.

The Software may include open-source software components governed by their respective licenses. Nothing in this EULA limits your rights under those open-source license terms where applicable.

This EULA is effective until terminated. It terminates automatically if you breach any term. Upon termination, you must cease all use of the Software and uninstall it from your devices or stop accessing the web application. Sections regarding ownership, restrictions, disclaimers, and limitation of liability survive termination.

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. MUFUNGO GEEKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUFUNGO GEEKS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

You agree to comply with all applicable export control and sanctions laws. You may not use or export the Software in violation of such laws.
